Challenging DUI Breathalyzer Results

You were pulled over for drunk driving, but you don't think you had that much to drink. Sometimes, the .08 percent blood alcohol (BAC) reading is just not right.
I am attorney Ernest Bauer, and I defend people charged with drunk driving, including challenging Breathalyzer and Intoxilyzer results.

I've seen the problems with the breath test.

I will investigate your DUI/DWI traffic stop and law enforcement's action to determine whether or not we can challenge the breath test or other chemical testing in your case. Depending on your circumstances, I may be able to argue that:
  • The police officer did not use the breath testing machine correctly
  • A condition you have (such as a lung or breathing problem) made the breath analysis results inaccurate or the breath sample too small
  • Environmental or work-related causes increased the BAC percentage
  • The Breathalyzer or Intoxilyzer is not a reliable test

Under Louisiana and federal law called "implied consent" law, you must submit to a breath test, chemical test or blood test when asked.
